Terms of sale

These terms cover your purchase and use of Octopus V2 (“Octopus”, “the software”), sold at gmapleads.online (“we”, “us”). By buying or using Octopus you agree to them. If you don't agree, please don't buy or use it.

What you're buying

A one-time payment of $99 USD gets you the Octopus V2 Windows app, its complete source code, and the license below. There's no subscription and no recurring charge. The license includes every update we release for version 2.

Your license, including resell rights

We grant you a perpetual, non-exclusive, worldwide license to:

• Use Octopus on as many computers as you own or control.
• Modify the source code and build your own versions.
• Rebrand it with your own name, logo and design.
• Resell or give away the compiled app (original or modified) to your own customers, at any price you choose, and keep all the revenue.
• Use it to provide services to your clients, such as lead lists or outreach.

What you can't do

• Resell, share, publish or give away the source code itself, in original or modified form, or sublicense these resell rights to anyone else.
• Share your download link publicly.
• Say or imply that your version is made, endorsed or supported by us. Your customers are your customers: you support them.
• Use it to break the law, including spam, harassment or illegal telemarketing.

Third-party open-source components keep their own licenses, which are included in the download.

Your responsibilities

Octopus helps you collect information businesses publish on Google Maps and, if you choose, send WhatsApp messages from your own account. You're responsible for how you use it and for the data you collect. That includes following Google's and WhatsApp's terms of service and laws such as the Telephone Consumer Protection Act (TCPA), CAN-SPAM, state privacy laws, and the rules wherever you or the people you contact are located. Google or WhatsApp may limit or block accounts or connections, and that's outside our control.

System requirements

Octopus runs on 64-bit Windows 10 or 11 with Google Chrome and an internet connection. It depends on third-party services (Google Maps, WhatsApp Web, Chrome) that can change at any time. We'll make reasonable efforts to keep Octopus working with them, but we can't promise uninterrupted results.

No warranty

Apart from the refund policy, Octopus is provided “as is,” without warranties of any kind, express or implied, including merchantability, fitness for a particular purpose and non-infringement, to the fullest extent the law allows.

Limitation of liability

To the fullest extent the law allows, we aren't liable for indirect, incidental, special or consequential damages, lost profits, lost data, or account suspensions that come from using Octopus. Our total liability for any claim is limited to the amount you paid for the software.

Independence

Octopus is independent software. It isn't affiliated with, endorsed by or sponsored by Google LLC or WhatsApp LLC. Their names are trademarks of their respective owners.

Changes

We may update these terms. The version in effect on the day you bought applies to your purchase.
